NEW YORK STATE (February 23, 2014) – Governor Andrew M. Cuomo recently announced that thousands of consumers who faced enrollment problems and other issues after signing up for health insurance with Empire Blue Cross Blue Shield (“Empire”) will receive three weeks of free coverage. The agreement follows a Department of Financial Services (DFS) probe into complaints about Empire sending out member ID cards late, failing to send out bills on time, and other issues.

“Empire did the right thing by working to address these issues and delivering relief to consumers,” said Governor Cuomo. “We will continue to work vigilantly to ensure that consumers receive the high standards of care and service that they deserve from their insurance companies.”

Benjamin M. Lawsky, Superintendent of Financial Services, said: “We acted swiftly to investigate these problems and work with Empire to correct them. We’re pleased that the company stepped up to acknowledge the issue and move to make progress toward fixing it.”

On January 9, DFS wrote to Empire urging that they take immediate action to rectify complaints about enrollment problems among consumers signing up for coverage through the New York State of Health (NYSOH) marketplace. Among the issues that DFS identified included:

Failure to Send Premium Bills and ID Cards on a Timely Basis. Many newly enrolled customers complained that Empire either failed to send premium bills, or else failed to send bills in a timely fashion. Furthermore, some newly enrolled consumers complained that they had not received member identification cards from Empire.

Failure to Ensure that Enrollees are Properly Transferred into Appropriate Plans. Consumers complained that Empire had no mechanism for transferring direct pay enrollees into new coverage.

Failure to Timely Answer or Handle Telephone Inquiries. DFS received reports that Empire was not answering calls from consumers and, in other instances, subjecting callers to unreasonably long wait times.

In recognition of these and other challenges faced by their policyholders, Empire has agreed to provide three weeks of free coverage to consumers who enrolled through NYSOH and paid for coverage for the month of January, but did receive care during that period. Those consumers will receive cash payments equivalent to three weeks of premiums paid. An estimated total of 15,000-20,000 Empire consumers are expected to receive this relief. Under the agreement, Empire has also committed $2 million to consumer education to encourage enrollment of the uninsured and others in health care coverage through NYSOH.

DFS will continue to monitor Empire’s implementation of new enrollment and compliance with this agreement. Consumers who wish to file a complaint about Empire or another insurer can call can contact the DFS Consumer Hotline at 212-480-6400 or 800-342-3736 for assistance.

Monticello Pantry Needs Assistance from the Community

MONTICELLO, NY (February 20, 2014) – The St. John’s Episcopal Church Food Pantry in Monticello is struggling to keep its shelves stocked and its doors open. The pantry, which is completely run by volunteers, serves as a lifeline against hunger for high-risk individuals and families including the elderly, children and the working poor.

In recent years, the economic downturn has led to a dramatic increase in the number of pantry clients. Over 200 families – between 800 and 1000 individuals – visit the pantry each month. St. John’s provides enough food for three days, as well as personal hygiene projects and other supplies. Through a needs-assessment system, pantry volunteers and representatives from area organizations also offer information about various community resources.

“It’s been difficult to meet the increased need in our community. At times, the food supply is exhausted well before the last week of the month,” said volunteer Jan Downing, who runs the pantry. “Other area pantries have closed or stopped accepting new people. So we began opening earlier, closing later, and we broadened our service area to the Town of Thompson and surrounding areas to try to meet the need,” said Downing, “but it’s been difficult.”

The pantry is open the first four Tuesdays of the month from 4 p.m. until 7:30 p.m. and the second Saturday of the month from 9:00 a.m. until 11:45 a.m. in the undercroft of St. John’s Episcopal Church (15 St. John Street, Monticello).

The St. John’s Episcopal Church Caring Hands Food Pantry has been an integral part of the Sullivan County community since 1994. As one of the only “choice” food banks in Sullivan County, St. John’s values its clients’ right to choose the foods that meet their diverse dietary needs.

“We’ve seen more and more low-income working people coming through our doors,” Downing said, “Many are just barely ineligible for public assistance and they need a little extra help. Increased unemployment and a growing homeless population have also brought our numbers way up.”

Individuals and organizations who want to help the pantry can contact Jan at jandowning1@hotmail.com or call 845-701-5277. Donations of food, money or time are greatly appreciated. Pantry volunteers are needed to provide referrals to clients, assist with food deliveries and distribution, and offer assistance with outreach and fundraising.

Checks can be made payable to St. John’s Episcopal Church Food Pantry and mailed to PO Box 107, Monticello NY, 12701. Food donations can be dropped off during the pantry’s operating hours.

(Editor’s note: Due to the economic hard times, it is common knowledge that all food pantries are finding it hard to serve their clients. Please consider helping not only St. John’s, but any food pantry in your geographical location.)

SULLIVAN COUNTY, NY (February 19, 2014) – The Awards Committee for the 2014 Nonprofit Leadership Summit is currently seeking applications for its Second Annual Nonprofit Innovation Award.

The award honors local nonprofit organizations that demonstrate innovation in the areas of collaboration, marketing, organizational operations and programs.  It offers a $5,000 cash prize, as well as an opportunity for the organization’s team to present its creative initiatives to the judges and nonprofit leaders at the March 27 event at Bethel Woods.

The size of the organization is not a major factor. Applications for this award are welcome from organizations at all levels, but the innovation(s) should generate demonstrable results and benefit the community at large.

“What is really exciting about the Innovation Award is that it rewards nonprofit leaders for thinking outside the box,” notes Irene Jones, Program Development Manager for Marshall & Sterling, Inc., who heads the 2014 Awards Committee for the Nonprofit Leadership Summit. “Today nonprofits are faced with stringent funding cuts, but they still must fulfill their missions.  The Innovation Award gives these pioneering nonprofits much needed funds, while building a culture of innovation and collaboration, as each finalist shares their innovative ideas with entire Summit audience.”

The presentation of the first Nonprofit Innovation Award was one of the highlights of the 2013 Summit. The Community Reporting Alliance, a youth-run community newspaper from Livingston Manor won with the first place prize. Runners up were Crystal Run Village and Rural & Migrant Ministry. The three finalists for the 2014 Innovation Award will be announced at a press conference prior to the Summit.

NEW YORK STATE (February 18, 2014) – Governor Andrew M. Cuomo recently announced that more than 6,700 wage theft cases were resolved in New York in 2013, more than in any other year. This resulted in the disbursement of nearly $23 million to more than 12,700 workers who were not paid their proper minimum wage, overtime pay or fringe benefits. This represents an increase of more than 12 percent in the number of closed wage theft cases compared to 2012.

“My administration has made it a priority to ensure workers in New York receive the compensation they deserve from their employers,” Governor Cuomo said. “When employers don’t pay proper wages and benefits under the law, not only is it illegal, but it is also unfair to the majority of other businesses in New York that do follow the rules. These figures from last year show that the State will not tolerate the abuse of workers and we will continue to actively defend their rights. I urge any worker who needs our help with labor issues to contact the Department of Labor immediately.”

The New York State Department of Labor (DOL), which has one of the largest labor standards enforcement staffs in the nation, continues to recover millions of dollars in stolen wages each year for workers through consistent and active enforcement.

“This is about much more than just numbers. This is about men and women who worked hard and were not paid their proper wages,” said DOL Commissioner Peter M. Rivera. “I urge any worker who believes he or she is being cheated out of money to contact the Department of Labor so we can investigate.”

In 2013, 6,533 new cases were opened and a total of 6,794 cases were closed. That is an increase of 36% in the number of cases brought to completion and closed as compared to 2012. 2013 also marks the first year in recent memory that more cases were closed than were opened, which is a direct result of changes to DOL’s investigative procedures.

Prior to 2013, DOL’s labor standards policy for investigations was to look back six years, which delayed many cases by forcing investigators to conduct lengthy searches for documents that no longer existed and interview individuals who did not remember that far back.

In 2013, the agency updated the look-back period to three years for most cases, which is still broader than both the federal government’s standard (two years) and the standard in most other states (one or two years). Updating this policy has ensured that the state can return money owed to workers more expeditiously. Since then, DOL has aggressively addressed its caseload and has resolved nearly all cases opened before 2011, thereby ensuring that workers will receive owed wages and receive those wages quickly.

In addition to this policy change, the investigative process is now being handled more efficiently. By the end of fiscal year 2014, DOL is aiming to have the average investigation completed in less than six months. In the first six months after the new policy change, the number of cases closed within six months has increased 54 percent. An annual breakdown of the percentage of cases completed since 2008 is as follows:

        Year
      2008
      2009
      2010
      2011
      2012
      2013
        Investigations Completed
      100%
      100%
      95%
      78%
      71%
      58%

The department’s change in policy has also had a very direct impact on reducing existing caseload. Over the course of 2013, overall caseload decreased by 13 percent – reversing a longstanding trend of annual net caseload growth due to outdated policies.

Additional policy changes that have contributed to the above successes include closing more cases through early settlement compliance conferences when appropriate, improving communication procedures with both claimants and employers and imposing strict time frames when requesting information from employers.

Anyone with questions about minimum wage or other labor standards issues, or who wishes to file a complaint, should call: 1-888-4NYSDOL (469-7365).

Delaware Valley Arts Alliance Launches 2014 Marketing Program

SULLIVAN COUNTY, NY (February 16, 2014) – The Delaware Valley Arts Alliance has launched its 2014 marketing campaign themed “Arts and Culture Provide a Boost to Our Economy.” The campaign will highlight the benefits that all local arts organizations bring to the economy of our region and how they enhance the quality of life for full and part-time residents and visitors.

The U.S. Bureau of Economic Analysis and the National Endowment for the Arts completed a study in 2011 showing that Arts/Culture and Tourism account for 6% of the Gross National product, a significant part of the U.S. economy. Art and culture generated $ 4.97 billion in economic activity, followed closely by tourism at $ 4.34 billion.

While arts organizations generate money for downtowns and businesses by creating activity and reasons for people to congregate and visit, they still struggle to finance and sustain programs. Private support is critical as government support dwindles.

The DVAA marketing package offers many opportunities, online and in print, that business can use to market their brand, including a four-color annual program; on-screen logos at the Big Eddy Film Festival; the Artsletter; the web; Riverfest and more.

For more information or to participate in this campaign call 845-252-7576.

The Youth Committee needs $1200 to make regular movie showings a reality. This will cover the cost of a year-long movie licensing fee and a projector. Sullivan Renaissance has generously provided a challenge grant of $250, but the Committee still needs $950 to meet its goal

At last fall’s Youth Speak Out event, co-sponsored by the Youth Committee of the Monticello Interfaith Council and the Sullivan County NAACP, area youth were asked what activities they wanted to see in Monticello. SULLIVAN COUNTY, NY (February 13, 2014) – Governor Andrew M. Cuomo has declared a state of emergency for the Mid-Hudson, New York City, After 3 Days of Snow - 2 and Long Island regions as a Nor’Easter storm continues to impact parts of the State.

Under a state of emergency, critical resources that are normally restricted to State use are mobilized to assist local governments and laws and regulations that would otherwise impede their rapid response are suspended.

“With this winter storm continuing to deliver snow, ice, and freezing rain across parts of the State, I am declaring a state of emergency in these regions so that we can continue to effectively respond to the storm and aid communities in need,” Governor Cuomo said.

“These regions are expected to continue to receive heavy snow that may accumulate at rates of around two to three inches per hour, which will make it difficult for plows to keep some roads clear. New Yorkers should stay off of the roads and remain in their homes until the worst of the storm has passed.”

NEW YORK STATE (February 10, 2014) – Governor Andrew M. Cuomo has announced that the 2014 Black History Month exhibit entitled, “The Solomon NorthrupTransformative Power of the Narrative,” is now open.

The exhibit, located in the War Room, is part of the State’s ongoing effort to create museum quality displays for public viewing at the State Capitol. Visit the Hall of Governors website to learn more about exhibits at the Capitol.

“In honor of Black History Month this year, New York State is pleased to celebrate the work of five storytellers who have made a lasting impact on American literature, media and society,” Governor Cuomo said. “From Solomon Northrup to Toni Morrison, these individuals were and continue to be pioneers in the fight for equality and justice in this country, and they continue to inspire people all around the world through literature, film and television today. During Black History Month, we are proud to celebrate the countless invaluable contributions of the black community that have made New York a stronger and more progressive state. NEW YORK STATE (February 7, 2014) – Earlier this week, Senator John Bonacic issued this statement on “Common Core.”

“Parents, teachers, administrators and educational professionals in my district, and throughout New York State, have raised grave concerns over the flawed roll-out of the Common Core Learning Standards.

“Unless the Board of Regents acts to alleviate these concerns, they must delay the use of Common Core tests for high-stakes decisions about teachers, principals and students for a minimum of two years. During this time, the State Education Department should continue to develop curricula aligned with higher standards and assist local school districts in developing their own curricula so teachers can successfully implement higher learning standards and help students reach their maximum potential.

“I continue to support the goals of an improved education curriculum that increases standards and ensures that students are college and career ready. It is my belief that while the implementation of the Common Core may have been well intended, it has been poorly executed.

“In addition, serious concerns have been raised about the ability of unauthorized third-parties to access personally identifiable information of students, teachers and principals that will be collected on the state-wide Education Data Portal. Therefore, I call for the Regents to delay operation of the Education Data Portal for at least one year.

“In the end, our goal must continue to be the development of higher learning standards in the best interest of our students and their futures.”

UNITED STATES (February 6, 2014) – Senator Kirsten Gillibrand and Congressman Sean Patrick Maloney recently announced federal legislation that would create paid family and medical leave. The Family and Medical Insurance Leave (FAMILY) Act would establish a national paid family and medical leave insurance program, ensuring that American workers would no longer have to choose between a paycheck and caring for themselves or a family member.

GILLIBRAND GRAPHIC “When a young parent needs time to care for a newborn child – it should never come down to an outdated policy that lets her boss decide how long it will take – and decide the fate of her career and her future along with it. When any one of us – man or woman – needs time to care for a dying parent – we should not have to sacrifice our job and risk our future to do the right thing for our family. Choosing between your loved ones and your career and your future is a choice no one should have to make,” said Senator Gillibrand.

“When my kids were babies, I was able to care for them. As my parents age, I want to be there for them. None of my neighbors in the Hudson Valley should have to struggle to put food on the table while caring for a newborn child or elderly parents. When President Clinton signed the Family and Medical Leave Act over twenty years ago, tens of millions of Americans no longer had to choose between their family or their paycheck, and this long overdue update will ensure all Americans can care for their loved ones,” said Rep. Sean Patrick Maloney, a former senior advisor to President Clinton.

“The Greater Hudson Valley Family Health Center values Senator Gillibrand’s innovative and broad-based approach toward developing programs that nurture families,” said Linda Muller, President and CEO, Greater Hudson Valley Health Center. “Her inspiring commitment toward building bipartisan consensus by considering the interests of all stakeholders while developing legislation that seeks to strengthen our communities, one family at a time, has repeatedly demonstrated her strength as a forceful and visionary advocate. In receiving the Senator at our health center, we embrace a leader who shares our core belief that health care is a right and not a privilege. I am proud to welcome her to Orange County’s and Newburgh’s Family Health Center.”

“Paid Family Medical Leave will ease the burden of so many employees that struggle to keep up financially at times when life has already brought an abundance of stress,” said Pamela Spieler, Vice President, Human Resources, Walden Savings Bank. “Whether it is working mothers who will be able to better respond to their family needs, or a worker that who requires time for their own significant health needs, The Family Act will create a better and more productive workforce…one that will make them feel safe and supported during a health related crisis.”

“With working moms now in the majority of households, workplace policies that support our dual roles as caregivers and professionals are essential to economic stability,” said Christine Sadowski, Executive Director, YWCA of Orange County and Chair of the NY State YWCAs. “Senator Gillibrand’s leadership on issues such as paid family and medical leave illustrate how tirelessly she advocates for women and their families. YWCAs throughout New York State look forward to working with her to get these policies implemented.”

Current Family and Medical Leave law provides unpaid, job-protected leave for serious health related events for only about half of the workforce. The other half don’t qualify for this unpaid leave, and many more simply cannot afford to take it because it is unpaid. In fact, only 12 percent of workers in the U.S. have access to paid family leave through their employers, and less than 40 percent of workers have access to personal medical leave through employer-provided temporary disability insurance.

The FAMILY Act would create an independent trust fund within the Social Security Administration to collect fees and provide benefits. This trust would be funded by employee and employer contributions of 0.2 percent of wages each, creating a self-sufficient program that would not add to the federal budget. The expected cost to the average worker would be similar to the expense of a cup of coffee a week. Benefit levels, modeled on existing successful state programs in New Jersey and California, would equal 66 percent of an individual’s typical monthly wages up to a capped monthly amount that would be indexed for inflation. The proposal makes leave available to every individual regardless of the size of their current employer and regardless of whether such individual is currently employed by an employer, self-employed or currently unemployed, as long as the person has sufficient earnings and work history.

NEW YORK STATE (February 5, 2014) – Governor Andrew M. Cuomo announced recently that the New York State Police will use social media to catch wanted individuals across the state. State Police will launch “Warrant Wednesday” on the Division’s Facebook page asking for the public’s help to track down people who have warrants out for arrest.

Beginning on February 5, the New York State police will implement the new, statewide initiative. Each Wednesday, wanted posters will be added to the NYSP Facebook page featuring posters of wanted persons with arrest or bench warrants from across New York State. Previous wanted postings on the State Police Facebook page, and the public’s assistance, have led to the identification and arrest of several individuals.

“New York State is using new and creative tools to help make our streets and neighborhoods safer,” said Governor Cuomo. “Social media’s broad appeal can help the State Police track down those wanted in connection with crimes and bring them to justice.”

“The State Police has already seen the benefits of broadening our use of social media,” said State Police Superintendent Joseph D’Amico. “We are expanding on a pilot program that we launched late last year that proved successful in the identification and arrest of several individuals. Expanding this initiative statewide will allow us to take full advantage of social media’s widespread reach to a large, diverse audience.”

Each “Warrant Wednesday” posting will include a poster of a wanted individual contributed by State Police Troops across the state. Each poster will include a photo, information about the subject, what they are wanted for, and a contact number for the appropriate State Police station. This will appear as a “photo album” on the State Police Facebook page.

The State Police needs the public’s assistance in this initiative and to help locate these wanted persons. The public is also encouraged to look at, share the postings each week.

It is important that anyone with information as to the whereabouts of the individuals not take any police action themselves and instead contact State Police.

To view the “Warrant Wednesday” postings, you do not need a Facebook account. You can see the postings by visiting the New York State Police Facebook page at www.facebook.com/nyspolice. If you already have an account, State Police invite you to “Like” the Division’s page.
Postings will also be shared on the New York State Police Twitter page at www.twitter.com/@nyspolice.
